Terms and conditions of Maxxima Sarl

Area of application

These General Sales Conditions (GSC) apply to all orders placed on the www.maxxima.ch website , governing contractual relations with Maxxima Sarl. Any terms and conditions of the customer that deviate from these General Terms and Conditions shall be considered null and void. Maxxima Sarl reserves the right to modify these terms and conditions at any time, without prior notice. Changes are effective as soon as they are published on the site.

Offers and Contract Conclusion

The information contained in catalogs and on the Internet is provided for information purposes only and does not constitute a contractual commitment. The order is validated by the customer by clicking on the online order button, which represents a firm commitment. Maxxima Sarl acknowledges receipt of the order immediately. In the event of unavailability or pricing error, the customer will be contacted to find an alternative solution. Product specifications (drawings, dimensions, weights, etc.) are given for information only and do not represent a guarantee of properties, unless explicitly stipulated.

Delivery

Delivery is handled by DHL in Switzerland and Liechtenstein for parcels up to 30 kg. For heavier orders, delivery is made by carrier to the nearest kerbside. Standard delivery time is 2 to 4 working days for items in stock. For made-to-order items, lead times will be communicated individually. Delivery dates are indicative unless otherwise agreed. Maxxima Sarl’s liability is limited to correct and timely delivery by its suppliers. For deliveries with assembly, accessibility must be ensured by the customer. Claims for visible damage or damaged packaging must be made immediately upon delivery. For hidden damage, claims must be made within 4 days.

Payment and Retention of Title

Accepted payment methods are : Credit card, TWINT. Maxxima Sarl retains ownership of the goods until full payment has been received.

Purchase on invoice

Payment by invoice is possible under certain conditions and is managed by a third party. Maxxima Sarl remains responsible for the contract, except for payment and collection aspects.

Reservation of Ownership

Goods remain the property of Maxxima Sarl until full payment has been received.

Warranty

Maxxima Sarl offers a 2-year warranty on products for manufacturing and operating defects, unless otherwise stated. The warranty is void if the operating or maintenance instructions are not followed, if unauthorized modifications are made or if third parties intervene. Minor deviations from the specification do not entitle the customer to warranty claims.

The return of goods is possible under certain conditions, with the prior agreement of Maxxima Sarl. Products must be returned within 10 days in their original condition and undamaged packaging. Return shipping costs are at the buyer’s expense. The customer is responsible for the appropriate packaging for the return shipment.

Digital Downloads

Digital downloads are not eligible for return or refund. Once the purchase has been confirmed and the download completed, the customer accepts that the product cannot be returned.

Data protection

Maxxima Sarl is committed to protecting its customers’ personal data.

Liability

Maxxima Sarl declines all responsibility for indirect damage resulting from the use of the online store or from orders placed.

Miscellaneous provisions

The place of jurisdiction is the registered office of Maxxima Sarl. Swiss law applies.
